CV Global Terms and Conditions

Christian Vision Global (CV Global) promotes the Christian faith globally through online mass media and the support of Christian mission workers, churches, mission organisations and mission projects on the ground.

CV Global consists of a number of entities including the large charitable organization Christian Vision (Registered Company No. 2842414/Registered Charity No. 1031031) and the Australian entity CV Digital Pty Ltd ACN 169 709 808.

CV Global’s Terms and Conditions (Terms) set out the basis on which you may access and use the CV Global website <www.cvglobal.co> (Website) and the CV Global software application (CV Application) (collectively CV Services).


1. Acceptance

(a) These Terms form the basis of the legally binding agreement between Christian Vision (Registered Company No. 2842414/Registered Charity No. 1031031) and you regarding your use of the CV Services.

(b) If you are accessing the Website and are not required to create an account, your continued use of the Website will constitute your acceptance of these Terms.

(c) Where you are creating a user account on the Website, or accessing the CV Application, you acknowledge and agree to be bound by these Terms where you:

(i) communicate to us (whether verbally or in writing) your acceptance of these Terms;

(ii) create an account to enable you to utilise or access content and information through our Website or the CV Application;

(iii) commence using the Website or CV Application, or commence accessing and using any content and information that we make available through the Website or CV Application.

(d) You must only use the Website and the CV Services in accordance with the provisions of these Terms.

2. Term

Your agreement with us commences upon your acceptance of these Terms in accordance with clause 1 and will expire in accordance with clause 12.

3. Use of CV Services

(a) You must only use the CV Services in accordance with these Terms.

(b) In order to use the CV Services we will provide you with functionality to create an account. You must not disclose your account details, including any passwords or access codes, to any other person.

(c) We have the right to disable any user account that you have created, including disabling your passwords or access codes at any time if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

(d) If you believe someone has access to your account, you must notify us immediately and, where possible, change your password.

(e) We may from time to time communicate with you using a number of mediums including by email, SMS text message to a mobile telephone number that you have provided (if any) or directly via the CV Application, and you authorise us to do so.

(f) You must comply with all applicable laws, regulations, codes and licensing requirements in your use of the CV Services.

4. Content

4.1 User Generated Content

(a) Our Website and the CV Application may allow you or other users of the CV Services to upload content and materials ( User Generated Content).

(b) We do not monitor User Generated Content and you acknowledge that we make no representations or warranties regarding the nature, accuracy or completeness of any User Generated Content.

(c) You must not upload any User Generated Content that is scandalous, abusive, inflammatory, discriminatory or contrary to law. Where you have uploaded such content, we reserve the right to suspend or terminate your access to the CV Services without notice or liability to you, and you agree to release and hold us harmless from any loss or damage that you may suffer as a result of us exercising our right to suspend or terminate your access.

(d) We may provide links to third party websites accessible through either the Website or the CV Application. Such third-party websites are not under our control and we cannot accept responsibility or liability in respect of the content made available through third party websites.

4.2 Website links

(a) You may link to the home page of our Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

(b) You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

(c) You must not establish a link to our Website in any website that is not owned by you.

(d) Our Website must not be framed on any other site, nor may you create a link to any part of our Website other than the home page.

(e) We reserve the right to withdraw linking permission without notice.

5. Intellectual Property Rights and Confidential Information

5.1 Licence

(a) Subject to your compliance with these Terms we grant you a non-exclusive, non-transferable and revocable licence to use the CV Services for the purposes of accessing the content and information that we make available through the Website and the CV Application.

(b) The licence provided in clause 5.1(a) is limited to your personal, non-commercial use of the CV Services and the content, information and materials made available through the Website and the CV Application.

(c) You must not modify any content, materials or information that you have accessed through the Website or the CV Application and must at all times maintain the integrity of the information, content and materials that you have accessed. You must at all times acknowledge our status (and that of any identified contributors) as the authors of content on our Website and the CV Application.

5.2 Intellectual Property Rights

(a) You must not without our express written authority engage in the use, copying, reproduction, display modification or distribution of any of the content available through either the Website or CV Application, including any text, software, scripts, flash files, graphics, photos, sounds, music, videos, business names, company names and logos.

(b) You must not utilise any tool, program, script or application for the purpose of scraping, indexing, surveying or otherwise data mining any portion of the Website or CV Application.

(c) You must not attempt to gain unauthorised access to or impair any aspect of the CV Services, or otherwise undertake or engage in actions that impede the operation or functionality of the CV Website or CV Application.

(d) Nothing in these Terms is to be construed as an assignment or transfer to You of any ownership rights in the intellectual property rights in the CV Services, or any content and materials belonging to us.

(e) We may provide you with the ability to upload content to our Website or the CV Application. Where you have uploaded content you grant us a perpetual, irrevocable, world-wide, royalty free, non-exclusive licence (including the right to novate or assign the licence, and to sub-licence) to use, reproduce and communicate all content and material uploaded by you or otherwise provided to us, for any purpose relating to the use of the CV Services, as well as incorporating such material into our own advertising, promotional and marketing campaigns.

6. Privacy

(a) In order to allow you to use the CV Services, we may be required to collect certain personal data from you.

(b) The nature of the personal information that we collect, and information regarding the manner in which we may use and disclose such personal information, is set out in our Privacy Policy

(c) All personal data that we collect and use is dealt with in accordance with the European Union General Data Protection Regulation 2016/679.

7. Warranties and Indemnity

7.1 Warranties

You hereby warrant to us that:

(a) you will not breach the rights of any third party in your use of the CV Services;

(b) where a third party has intellectual property rights in content and materials you have uploaded to either the Website or the CV Application, you have the required authority and consent to grant us a license to use such content and materials in the manner contemplated by these Terms;

(c) you will not upload content and material to our Website or the CV Application that is misleading, deceptive or false, obscene, indecent or offensive in nature;

(d) you will not use the CV Services, or any content or materials that we make available to you, in a manner that does or is likely to bring us into disrepute or to damage our reputation;

(e) you will not breach any laws, regulations, codes or applicable rules (whether statutory or at common law) in your use of the CV Services; and

(f) you have the authority and capacity to enter into this agreement with us and to be bound by your obligations under these Terms.


8. Content

(a) For the purposes of this clause 9 the term “Loss” includes any damage, loss, cost, liability or expense of any kind and however arising (including as a result of any demand, claim, action, dispute or proceeding) including penalties, fines and interest whether prospective or contingent and any amounts that for the time being are not ascertained or ascertainable.

(b) You hereby indemnify and keep us indemnified against any Loss that may be incurred or suffered by us arising from or in connection with:

(i) any breach or default by you of these Terms (including any breach of warranty);

(ii) a negligent act or omission by you;

(iii) your failure to comply with any applicable law, regulation, code or rule;

(iv) your failure to comply with your contractual obligations to any third party insofar as such obligations arise or relate to the use by you of the CV Services; and

(v) any demand, claim, action, dispute or proceeding made or brought against us as a result of an act or omission by you or resulting in any way from the upload of content and materials to our Website or the CV Application by you.

(c) The indemnity that you are providing under clause 8(b) will be reduced proportionately to the extent that we have contributed to any Loss suffered or incurred by us through our own negligent act or omission.

(d) This clause 8 survives the termination of our agreement with you on the basis of these Terms.

9. Patron Acknowledgements

(a) You acknowledge and agree that:

(i) computer and software services are not fault free and occasional periods of downtime may occur with regard to the CV Services;

(ii) we have not made any representations or warranties that the CV Services will be error free, free of viruses or available without interruption; and

(iii) we do not endorse, make any warranties or bear any responsibility with regard to content uploaded by other users of the CV Services;

(iv) the breach by you of any applicable law, code or regulation in your use of the CV Services will constitute a breach of your obligations under these Terms

(v) if we think it is reasonable to do so, we may immediately suspend your access to the CV Services, remove or amend any content or material you have uploaded, or take any other steps we deem reasonably necessary or appropriate to protect our interests or those of third parties; and

(vi) we will not be responsible for any loss, damage or expense you may suffer or incur, whether direct or consequential, arising from or relating to the exercise of our right to suspend or terminate your access to the CV Services in accordance with these terms.

10. Warranties and Limitations of Liability

(a) Unless otherwise required by law, our liability for any breach of these Terms in contract or tort (including negligence) is limited at our option to:

(i) the resupply to you of the CV Services at no cost to you; or

(ii) a monetary amount equivalent to the cost of resupplying the CV Services to you.

(b) To the maximum extent permitted by law, we will not be liable for any loss of profit, loss of goodwill, loss of opportunity or any special, punitive, indirect or consequential loss or damage incurred by you or by any other person whether directly or indirectly related to these Terms.

(c) We are not liable for any loss or damage caused to you by reason of any delay, lack of supply, industrial action, fire, riot, war, embargo, civil commotion, act of God or any other event which is beyond our control.

11. Termination

(a) You may terminate this agreement at any time by:

(i) deleting the user account (if any) that you have created to use our Website and ceasing using the CV Services in any capacity;

(ii) deleting the user account that you have created to access the CV Application and deleting the application; or

(iii) contacting us and requesting that wWe delete your use account (whether on the Website or within the CV Application) and requesting that we terminate your access to the CV Services.

(b) We may terminate this agreement with you at any time by:

(i) terminating your access to the CV Services; or

(ii) by notification to you in writing,

where we consider it reasonable in the circumstances to do so.

12. General

(a) We may amend these Terms at any time. Where we are required to amend these Terms, we will use our reasonable efforts to provide you with notice of such amendment. However, you acknowledge that it is your obligation to regularly check these Terms.

(b) If you continue to use the CV Services following our amendment to these Terms, you will be deemed to have accepted the amendment and to agree to be bound by such amendment.

(c) We may, upon notice in writing to you, assign or otherwise transfer the benefit of all or any part of these Terms to any other person or entity. You must not assign, novate or otherwise transfer any rights, benefits or liabilities relating to these Terms without our prior written consent.

(d) These Terms are governed by the law in force in the State of Queensland, Australia and each party submits to the exclusive jurisdiction of the courts of Queensland, Australia and the courts competent to determine appeals from those courts, in relation to any proceedings that may be brought at any time relating to these Terms.

(e) Any provision of these Terms that is illegal, void or unenforceable will be severed without prejudice to the balance of the provisions of these Terms which shall remain in force.
